مدى تمتع عقود خدمات المعلومات بالطابع الدولي

تمثل التعاملات الإلكترونية أهمية كبرى لدي شعوب العالم، خاصةً ما يتعلق منها بالتطور التكنولوجي للمعلومات، لذلك أصبح لعقود خدمات المعلومات دور مهم في هذا التطور التكنولوجي والتقدم التقني للمعلومات، ونظرًا لحداثة هذا الموضوع كان لابد من وضع قواعد قانونية تنظمه، خاصة وأن المشرع لم يضع تعريف جامع مانع لعقود خدمات المعلومات بل ترك الأمر للفقه والقضاء، وكان لابد أيضًا من ايضاح الطبيعية القانونية لعقود خدمات المعلومات وإدراجه تحت قسم من أقسام العقود المسماة أو العقود غير المسماة أو ادراجه تحت عقود الإذعان، وكذلك بيان مدى تمتع عقود خدمات المعلومات بالصفة الدولية.
Abstract:
Electronic transactions represent great importance to the peoples of the world, especially those related to the technological development of information. Therefore, information services contracts have an important role in this technological development and the technical progress of information. Given the novelty of this topic, it was necessary to establish legal rules that regulate it, especially since the legislator did not set a definition. A comprehensive prohibition against information services contracts, but rather leaving the matter to jurisprudence and the judiciary. It was also necessary to clarify the legal nature of information services contracts and include it under a section of named contracts or unnamed contracts or include it under contracts of adhesion, as well as clarifying the extent to which information services contracts enjoy international status.
